Ms. Samantha Tanyala Mbikiwa
The Managing Partner & Head of Litigation
Ms. Mbikiwa’s legal journey began in 2002 after obtaining her LLB from the University of Botswana. She joined the Directorate of Public Prosecutions, where her brilliance quickly elevated her to the role of Principal Prosecutions Counsel. In that capacity, she oversaw high and low profile criminal prosecutions and helped shape Botswana’s criminal law through precedent-setting cases. She also served on national committees such as the Anti-Money Laundering National Committee and the Extradition National Committee, representing the Attorney General and the DPP at the highest level.
PIONEERING TO PRIVATE PRACTICE - CLASS ACTION LITIGATION
Building on her success in public service, Ms. Mbikiwa transitioned to private practice, where she continues to make an indelible mark. She is Botswana’s leading expert in class actions against government, particularly in matters involving stand-alone positions, multiple grading and titling, scarce skills allowances, and leave pay for public employees. She is currently representing over 200 distinguished groups comprised of public service teachers, radiologists, drivers, secretaries and many more.
She has consistently set precedents in this area, with landmark judgments including but not limited to:
Sefhore Andreas & Others v. Attorney General (Court of Appeal) - the locus classicus on multiple grading and titling of C-band positions.
Kamogelo Lekagane & Others v. Attorney General (High Court) addressing multiple grading, titling, and stand-alone positions for public employees.
Her trailblazing work has solidified her as the go-to litigator in class action cases that continue to define Botswana’s labour law and public service landscape. She holds many more judgments under her belt, which will, in time, be shared with the public on this platform.
EXCELLENCE IN FAMILY LAW
As Head of the Family Law Department, she is equally recognized as a leading figure in Botswana’s family law, handling divorce, child custody, maintenance, universal partnerships, and related disputes. She has participated in precedent-setting cases, including but not limited to:
Goitsemodimo v. Goitsemodimo (Court of Appeal) - which addressed the treatment of pensions within the joint estate.
Sethono v. Sethono (Court of Appeal) - another landmark case shaping Botswana’s family law.
Her shrewdness in navigating sensitive family disputes has earned her a reputation as a compassionate yet highly tactical lawyer. Furthermore, she has pioneered a holistic approach by facilitating in-house counselling services, delivered by exceptionally qualified therapy experts to her clients. This has ensured that clients not only receive trusted legal representation but also the emotional and psychological support needed during challenging family transitions.

Beyond class actions and family law, Ms. Mbikiwa has represented a wide spectrum of clients, from regulatory bodies, corporates, SMEs, and private individuals. She has successfully handled labour and employment disputes, contractual disputes, commercial law cases, medical negligence cases, criminal cases, arbitrations, mediations, and sat on multiple disciplinary hearings consistently delivering outstanding results.
